CALL TO ORDER

Chairman Bracken called the meeting to order and welcomed those in attendance. Chairman Bracken led the flag salute.

ZONE CHANGE REQUEST PUBLIC HEARING (5:00 P.M.)

Consider a zone change request from A-1 (Agricultural) to the RE-12.5 (Residential Estates 12,500 square foot minimum lot size) zone on 10.778 acres. The property is located south of Sun Valley Estates Phase 6 and east of Sun Valley Estates Phase 5. The applicant is Quality Development. Case No. 2011-ZC-013

Craig Harvey Planner I said this is a request to rezone an A-1 to RE-12.5 with a Deed Restriction. This is 10.778 acres with 2 du/ac and that is roughly 21 dwelling units per acre. All streets will be public streets. If the Planning Commission finds that this project is in the best interest of the City, then Staff recommends approval with one condition at the applicants request that the average project density shall not exceed two dwelling units per acre.




MOTION: Commissioner Campbell made a motion to recommend to City Council approval for a zone change request from A-1 (Agricultural) to the RE-12.5 (Residential Estates 12,500 square foot minimum lot size) zone on 10.778 acres. The property is located south of Sun Valley Estates Phase 6 and east of Sun Valley Estates Phase 5. Include in the motion that subject parcel shall not be higher than 2 dwelling units per acre. Commissioner Taylor seconded the motion. All voted aye.

PRELIMINARY PLATS

A. Consider a preliminary plat request for The Estates at Valderra to create a 40 unit
subdivision. The applicant is Valderra Land Holdings LLC, the representative is Mr. Alan Wright, and the engineer is Mr. Paul Blackmore of Blackmore Engineering. The property is zoned PD-RES (Planned Development Residential) and is located in the ledges and is situated on the west side of State Route 18. Case No. 2011-PP-011

Wes Jenkins Development Services Manager said this request is to approve a forty lot subdivision. The property is located in the Ledges and is situated on the west side of State Route 18. The subdivision is 32.5 acres which is 1.42 dwelling units per acre. This project is 40 units on 28.1 acres. The other 4.4 acres are a future planned development. The units will be on a proposed Private Drive. Staff comments are;

1. This development was originally approved by City Council on February 7, 2008 as a 40 lot
subdivision called Phase 11 at the Ledges. In May 2010 a revised preliminary plat called the Estates at Valderra was approved by City Council. This revised preliminary plat contained 26 one-acre lots. In June of this year, a revised preliminary plat was approved for 20 single family lots and a 15 lot planned development plus a lot for a future spa.

2. There is a 300-foot setback from Snow Canyon Park where homes constructed within this
setback have to be one-story homes.

MOTION: Commissioner Wilkinson made a motion to recommend to City Council approval for a preliminary plat request for The Estates at Valderra to create a 40 unit
subdivision along with staff comments. Commissioner Taylor seconded the motion. All voted aye.

B. Consider a preliminary plat for Desert Canyons Town Center Commercial a 10 lot
commercial subdivision. The applicant is Desert Canyons, the representative is Mr. Curt Gordon, and the engineer is Mr. Ken Miller. The property is zoned CRM (Mixed Use Commercial) and is located in the SW section of Section 26 T43S, R15W SLB&M along Desert Canyons Parkway (Exit 6 Southern Parkway). Case No. 2011-PP-010




Wes Jenkins Development Services Manager said this is a request to approve a ten lot mixed use commercial subdivision. Desert Canyons Parkway and Cottonwood Crossing Drive will be the access to these lots. A conditional letter of map revision has been approved by FEMA for the modifications to the Fort Pierce Wash. Desert Canyons Parkway and Cottonwood Crossing Drive are the roadways that will provide access to the development. Cottonwood Crossing Drive will have to be dedicated with this subdivision plat.

MOTION: Commissioner Hullinger made a motion to recommend to City Council approval for a preliminary plat for Desert Canyons Town Center Commercial a 10 lot
commercial subdivision. Commissioner Campbell seconded the motion. All voted aye.

C. Consider a preliminary plat for Sunland Professional Park a 4 unit commercial
subdivision. The applicant is Sunland Professional Park LLC, the representative is Mr. Troy Ence, and the engineer is Reid Pope. The property is zoned AP (Administrative Professional) and is located at the NW intersection of Sunland Drive and Riverside Drive. Case No. 2011-PP-012

Wes Jenkins Development Services Manager said they share water and sewer normally they would have to come back in and get a separate agreement for each to have their share.

Assistant City Attorney Joseph Farnsworth said they are working with Ences lawyers to finalize an agreement which will be recorded on the property. They have agreed to work off a common water meter. The property owners will need to share the maintenance costs. It will be basically a maintenance agreement between the owners of the buildings.

Vince Clayton representative for Ence said they are not changing the use of the buildings; it will be exactly that same. The reason for this request is the banks wont finance four properties but will finance on one building. It is strictly to survive the economically times.

MOTION: Commissioner Campbell made a motion to recommend to City Council approval for a preliminary plat for Sunland Professional Park a 4 unit commercial
subdivision. Commissioner Taylor seconded the motion. All voted aye.

D. Consider a preliminary plat for Ence Executive Towers a 2 lot subdivision. The
applicant is Bluff towers LLC, the representative is Mr. Troy Ence, and the engineer is Reid Pope. The property is zoned C-2 (Highway Commercial) and is located at the southeast corner of 600 South Street and Bluff Street. Case No. 2011-PP-013

Wes Jenkins Development Services Manager said this is the preliminary plat for Phase 2. This project consists of two (2) existing buildings owned by Ence Brothers. They want to plat each building so that they are each on their own lot. This gives them greater flexibility with this project to get financing with banks, sale one building and keep the other, or sale both buildings, or just whatever they need to do to keep things operating successfully.

MOTION: Commissioner Taylor made a motion to recommend to City Council approval for a preliminary plat for Ence Executive Towers a 2 lot subdivision subject to the legal requirements and agreement that will be in place when that split is made. Commissioner Campbell seconded the motion. All voted aye.

E. Consider approval of a preliminary plat for Blackberry Court Phase 2 to create a
seven (7) lot residential subdivision. Located in the Bloomington Development at approximately 1090 West and 3690 South which is south of where Baneberry Drive and Mulberry Drive meet. Rosenberg and Associates are the representatives. Case No. 2009-PP-003

Wes Jenkins Development Services Manager said this is the preliminary plat for Phase 2 of Blackberry Court in the vicinity of Mulberry Drive and Baneberry Drive at 1090 West. This preliminary plat was previously approved by the City Council in April 2009, but the associated final plat was never recorded and has since expired. This preliminary plat is now being re-submitted. This request is to create an R-1-10 subdivision with 7 lots. The FEMA map was amended in 2008 for this site, but FEMA revised there map in 2009 and did not include the 2008 changes. This plat approval is contingent upon a re-certification by FEMA.

Wes said the erosion protections for the Blackberry Court Subdivision is provided by rock rip rap placed along the east and south side of the project area. Placement took plat in 2007. As additional setback of 20 is recommended adjacent to the Rip-Rap so the total setback would be 30. The plans shows a landscape area labeled as REMAINDER located on the northwest corner of the subdivision. The City does not want the responsibility of installing or maintaining this landscape area. Staff recommends that the developer provide a plan for the construction, installation, and long term maintenance of this area.

MOTION: Commissioner Wilkinson made a motion to recommend to City Council approval a preliminary plat for Blackberry Court Phase 2 to create a seven (7) lot residential subdivision subject to the recertification agreement through FEMA and the developer provide a plan for the constructions, installation, and long term maintenance of remainder parcel. Commissioner Hullinger seconded the motion. All voted aye.

FINAL PLATS

A. Consider approval of a roadway dedication final plat for Lava Flow Drive and Little
League Drive located on the north side of Sunset Blvd. and approximately 2400 West. Alpha Engineering is the representative. Case No. 2011-FP-032

Wes Jenkins Development Services Manager said this is a request for a Roadway Dedication Final Plat. The road has been there for some time they are just bringing it in to dedicate it to the City.

MOTION: Commissioner Campbell made a motion to recommend to City Council approval for a roadway dedication final plat for Lava Flow Drive and Little League Drive located on the north side of Sunset Blvd. and approximately 2400 West. Commissioner Wilkinson seconded the motion. All voted aye.

B. Consider approval of a final plat for Sage Meadows Phase 1 to create a one (1) lot
subdivision. The owner is WCSD (Washington County School District). The applicant is Mr. Mel Ashcraft and Alpha Engineering is the representative. The property is zoned A-20 (Agricultural 20 acre minimum) and is located at the northeast corner of 2780 East and 2000 South. Case No. 2011-FP- 031

Wes Jenkins Development Services Manager said this is the future site of an Elementary School for the Washington County School District.

MOTION: Commissioner Taylor made a motion to recommend to City Council approval for a final plat for Sage Meadows Phase 1 to create a one (1) lot subdivision and authorize Chairman to sign. Commissioner Campbell seconded the motion. All voted aye.

C. Consider approval of a final plat for Tonaquint Terrace Phase 2, Second Amended
and Extended to create a sixty-five (65) lot residential subdivision located at 1300 West Street and 2270 South Street within the Tonaquint Development. Bush and Gudgell Engineering is the representative. Case No. 2010-FP-008

Wes Jenkins Development Services Manager said this is the 2nd amendment and extension request for Tonaquint Terrace Phase 2. The amended and extended plat contains the Lot Line Adjustments for Lots 128, 129, 130, 131, 156, 159, 160, and 169. The old easement areas defined in the plat details shall be abandoned with this plat. The new lots lines specified in the plat shall have easements as defined by Note 2. No other changes have been made.

Ryan Thomas with Bush & Gudgell addressed questions from where the extra land space is coming from. He stated it will not affect the rock formation that is currently out there.

MOTION: Commissioner Hullinger made a motion to recommend to City Council approval for a final plat for Tonaquint Terrace Phase 2, Second Amended and Extended to create a sixty-five (65) lot residential subdivision located at 1300 West Street and 2270 South Street within the Tonaquint Development and authorize Chairman to sign. Commissioner Wilkinson seconded the motion. All voted aye.

D. Consider approval of a final plat for Blackberry Court Phase 2 to create a seven (7)
lot residential subdivision. Located in the Bloomington Development at approximately 1090 West and 3690 South which is south of where Baneberry Drive and Mulberry Drive meet. Rosenberg and Associates are the representatives. Case No. 2010-FP-031

Wes Jenkins said this is an approval of a 7 lot residential subdivision. The zone is R-1-10. With regards to the flood plain and the remainder parcel that will need to be part of the motion.

MOTION: Commissioner Campbell made a motion to recommend to City Council approval for a final plat for Blackberry Court Phase 2 to create a seven (7) lot residential subdivision with requirement that signing of the plat needs to be done and that the certified FEMA map be in hand also. Commissioner Taylor seconded the motion. All voted aye.
