CALL TO ORDER

Chairman Ron Bracken called the meeting to order and welcomed those in attendance. Chairman Ron Bracken led the flag salute.

FINAL PLAT

Consider a final plat request for Silver Cloud Drive a private roadway dedication plat, serving the Ledges located at approximately 1900 West and 5000 North on the west side of the west UDOT round-about (on the west side of the SR 18). Mr. Roger Bundy is the representative. Case No. 2010-FP-020

Todd Jacobson, Project Manager said this is a roadway dedication plat. The zoning is PD. It will be the main road going into Ledges. The name may change some other time but for now will be called Silver Cloud Drive.

MOTION: Commissioner Hullinger made a motion to recommend to City Council approval for a final plat request for Silver Cloud Drive a private roadway dedication plat, serving the Ledges located at approximately 1900 West and 5000 North on the west side of the west UDOT round-about. Commissioner Burks seconded the motion. All voted aye.

LOT SPLIT

Consider a lot split request to legally divide one parcel into two for property located on the north side of 3670 South between Little Valley Road and Bentley Road. The existing lot is 7.378 acres (321,386 square feet). The proposed parcels would be; Parcel 1 = 3.106 acres (135,297 square feet) and Parcel 2 = 4.272 acres (186,089 square feet). The property is zoned RE-37.5 (Residential Estates - 37,500 square foot minimum lot size). The applicants are Ms. Linda Peterson and Mr. Corey Shamblen. Bush and Gudgell, Inc. is the representative Case No. 2010-LS-004

Planner Craig Harvey said the applicant is trying to rectify an illegal lot split. There are easements around the property and they will abandon one of the easements. Staff recommends approval however they need to dedicate the roadway through there.

Craig stated the following staff comments:

1. The applicant/owner of Parcel 1 will be required to vacate the easement that will be in
the middle of the parcel after the split. That action will be part of another case and require City Council approval.
2. Before either parcel can be developed, the road must be dedicated
3. Staff recommends the following standard conditions be applied.
a) Provide separate deed for each created parcel to be recorded with the Council approval and stamped approved by Planning Staff.
b) In addition to the legal descriptions that appear on the R.O.S. the applicant shall provide the City with separate 8-1/2 x 11 legal descriptions for each parcel.
c) A utilities and drainage easement shall be completed, notarized, and recorded for each parcel.
d) The applicant shall submit for review all legal documents to the City Attorneys Office.

Commissioner Read asked if the roads should be dedicated before improvements.

Craig replied they should be.

MOTION: Commissioner Taylor made a motion to recommend to City Council approval for a lot split request to legally divide one parcel into two for property located on the north side of 3670 South between Little Valley Road and Bentley Road and include staff comments and road dedication. Commissioner Burks seconded the motion. All voted aye.

ZONING REGULATION AMENDMENT PUBLIC HEARING (5:00 P.M.)

Consider a zoning regulation amendment to the City Zoning Regulations; Title 10 Zoning Regulations, Chapter 7 Residential Zones, amending sections 10-7A-2 Residential Estate Zones, 10-7B-2 Single-Family Residential Zones, 10-7C-2 Multiple Family Residential, and 10-7D-3 Mobile Home Zones, also Chapter 8 Planned Development Zones, amending section 10-8-2 Planned Development Zones, and Chapter 5 Agricultural Zones, amending 10-5-2 Agricultural Zones regarding church as a permitted use. City of St George, applicant. Case No. 2010-ZRA-003

Planner II Ray Snyder read into record the chapters that will be reworded to allow churchs as a permitted use. Ray read into record the Federal Religious Land Use and Institutionalized Persons Act of 2000.

Ray asked if the Deputy City Attorney Paula Houston had anything to add.

Deputy City Attorney Paula Houston said she did not.

Commissioner Read asked if there was a definition for churches.

Deputy City Attorney Paula Houston said there is not, nor does the Federal Religious Act.

Commissioner Taylor asked about reviewing the building designs on the churches, and what role the Planning Commission would play.

Deputy City Attorney Paula Houston said churches would have to comply with other ordinances such as parking, lighting, and height requirement. They could come in with different designs but they still need to comply with the building code.

Commissioner Taylor said one could come up with an extreme church design in a residential area. He wonders if the requirements are adequate.

Deputy City Attorney Paula Houston said they could currently design a building with extreme designs under the current law as long as they meet building code.

Commissioner Burks asked does the word church cover any meeting house.

Deputy City Attorney Paula Houston replied it does.

MINUTES

Consider approval of the Planning Commission minutes for July 27, 2010.

MOTION: Commissioner Taylor made a motion to recommend approval of the minutes into record. Commissioner Burks seconded the motion. All voted aye.
