ST. GEORGE CITY COUNCIL MINUTES
REGULAR MEETING
DECEMBER 28, 2009, 4:00 P.M.

OPENING:
Mayor McArthur called the meeting to order and welcomed all in attendance. The pledge of allegiance was led by Mayor McArthur and the invocation was offered by Jon Pike.

PUBLIC HEARING/ORDINANCE:
Public hearing to consider approval of an ordinance annexing into the City of St. George from Washington County property known as the St. George Replacement Airport.

Mayor Dan McArthur explained that St. George City and Washington City have agreed on boundaries between the two cities. This action is needed to ensure that the Replacement Airport is located entirely within the City of St. George. The new airport will open January 13, 2011. He then opened the public hearing. There being no public comment, he closed the public hearing.

City Manager Gary Esplin commented approval of this ordinance is the final action needed in order to annex the property. 80% of the property owners have signed the petition. No protests to the annexation have been received. This annexation includes the Kelly Klein, Land Baron and Peterson parcels and, as agreed to with Washington City, allows the owners of property north of the airport to petition whichever City they choose to be annexed into.

City Attorney Shawn Guzman advised that a boundary line adjustment with Washington City will be the last step in the annexation process.

MOTION: A motion to approve the annexation ordinance was made by Councilmember Allen.
SECOND: The motion was seconded by Councilmember Bunker.
VOTE: Mayor McArthur called for a roll call vote as follows:

The vote was unanimous and the motion carried.

PUBLIC HEARING/ORDINANCE:
Public hearing to consider a request to vacate the Cornerstone Subdivision plat located at 2800 South and 3000 East along with a portion of four public roadways (Seegmiller Drive, 3040 East, 3090 East and a future 66' road) along with all public utility easements.

City Attorney Shawn Guzman explained Mr. Larsen is now the owner of the Cornerstone Subdivision property. He displayed the plat map. He recommended that the plat be vacated less and excepting the equestrian trail and public roadway dedication along 3000 East and the easement along the extension of Seegmiller Drive, and subject to legal review. He advised that the ordinance vacating the plat and deeds of dedication will be recorded simultaneously.

City Manager Gary Esplin explained Mr. Larsen is willing to donate property to the City so he can receive a tax benefit this year. The donation must be accepted this year even though negotiations have not been finalized.

City Attorney Shawn Guzman recommended the Cornerstone Subdivision plat be abandoned less and excepting the dedicated roadway and equestrian trail along 3000 East and the City easement north of the extension of Seegmiller Drive, subject to legal review, and that the City accept the donation of property from Mr. Larsen.

Mayor McArthur advised that the public hearing was still open from the last City Council meeting. He inquired if there was any public comment.

Mr. Larsen commented that he loved and appreciated the many trails in St. George.

There being no further public comment, Mayor McArthur closed the public hearing.

MOTION: A motion was made by Councilmember Almquist to approve the abandonment of the Cornerstone Subdivision plat by ordinance less and excepting the dedicated roadway and equestrian trail along 3000 East and the City easement north of the extension of Seegmiller Drive, subject to legal review, and to accept a donation of property from Mr. Larsen.
SECOND: The motion was seconded by Councilmember Pike.
VOTE: Mayor McArthur called for a roll call vote, as follows:

The vote was unanimous and the motion carried.

MISCELLANEOUS REPORTS:
Police Chief Marlon Stratton reported that during this holiday season the Department is seeing an increase in phone and internet scams as well as family fights.

Support Services Manager Marc Mortensen reported that the City is ready for First Night which will be held from 7:00 p.m. until midnight on New Years Eve at the Town Square. There are 28 venues.
