RESOLUTIONS:
Consider adoption of a resolution authorizing and approving the Washington County/St. George Interlocal Agency, Washington County, Utah (the ?WCIA?) to release any security interest the WCIA has in any improvements that were built and financed with the proceeds of the WCIA?s Lease Revenue Bonds, Series 1997A, on the real property the WCIA leased from the United States Bureau of Land Management pursuant to a ground lease agreement; authorizing and approving the release of a portion of the property originally pledged as collateral for the WCIA?s Lease Revenue Bonds, Series 2003; and approving the execution and delivery of certain release documents to accomplish the same; authorizing the taking of all other actions necessary to the consummation of the transaction contemplated by this resolution; and related matters.

City Manager Esplin explained the resolution will release the City?s interest in the property that is being sold to the Hilton Corporation a clear title to the property can be issued.

Motion and vote:

Motion carried

Consider adoption of an ordinance to vacate a potion of Middleton Drive.

City Manager Esplin recommended tabling this item.

Consider a resolution to file an action for declaratory judgment regarding property on the 200 East extension.

City Manager Esplin explained this resolution is to provide an answer to the court that the City has the right to vacate the property.

Council Member Gardner indicated he went to the site and felt that it looked different than it did on paper. He indicated that perhaps the City is taking enough of the property that the owners will be adversely affected and that there is more damage than what Public Works Director Bulloch has described.

Motion and vote:
Council Member Whatcott made a motion, seconded by Council Member Bunker to adopt a resolution to file an action for declaratory judgment regarding property on the 200 East extension.

Consider adoption of a resolution amending a previous resolution authorizing the exercise of eminent domain power held by the City of St. George to acquire by negotiation or condemnation real property or interest in real property located at approximately 1275 East Highland Drive.

City Manager Esplin explained the prior resolution is being amended it because the City doesn?t need the whole parcel. He doesn?t expect the property owners to fight the condemnation of the
